    It doesn't matter if the code is legit or not. The thing that matters is that it's considered RMT so it would be your own fault for not reading the rules carfully enough like any other trade.

    Their problem then, since they willingly did it.
    Plus if anyone wanted to do this they should have done it before the TOS included the RMT penalty.

    This is what I'm trying to say. If you loose a item you can always replace it with a item that's exactly the same, or get one that's even better than the original.
